NFT日本酒「雷鳥」（以下「本商品」といいます。）の購入者又は保有者（以下「購入者等」といいます。）が閲覧又はダウンロードその他の利用を可能となる、画像、テキスト、音声及び動画等のあらゆるコンテンツ（以下「本コンテンツ」といいます。なお、購入者等以外の者が利用可能であるか否かを問いません。）に関する著作権、特許権、実用新案権、商標権、意匠権その他一切の知的財産権（これらの権利について登録等の出願をする権利を含みます。）は、株式会社CoworkingKitchenに留保されます。すなわち、本NFT又は本コンテンツにかかるデータ（以下「本NFT等」といいます）を保有することは、本コンテンツに関する知的財産権の譲渡又は利用許諾を受けることを意味しません。

したがって、本NFT等の保有者であっても、本コンテンツの権利者である株式会社CoworkingKitchen（若しくは管理委託先）から別途の承諾を得ずに、個人による閲覧の範囲を超えた利用、商用利用その他の法律上権利者の承諾を必要とする行為(改変、公開、配布、逆コンパイル及びリバースエンジニアリングを含みますが、これらに限りません。)を行うことはできません。

株式会社CoworkingKitchenは、本NFT等について、事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ等を含みます。）がないこと、及び、あらゆる環境において利用可能であることを保証するものでなく、当該瑕疵又は購入者等が使用するコンピューター、回線、ソフトウェア若しくはプラットフォーム等の環境にもとづき生じた損害について、一切の責任を負わないものとします。また当社は、本サービスに関して、購入者等と第三者との間において生じた取引、連絡または紛争等について一切責任を負わないものとします。

上記にかかわらず、消費者契約法の適用その他の理由により免責が制限される場合、株式会社CoworkingKitchenの責任は、債務不履行または不法行為により購入者等に生じた損害のうち現実に発生した直接かつ通常の損害に限るものとします。また、かかる場合の賠償金額の上限は、本NFTに関して株式会社CoworkingKitchenが最初に購入者から販売代金として受領した金額とします。ただし、当社の故意又は重過失に起因する場合はこれらの限定を設けずに賠償をするものとします。

 

 

The purchaser or holder of this NFT (hereinafter referred to as the "Purchaser, etc.") (hereinafter referred to as the "Purchaser") may view, download, or otherwise use any and all content, including images, text, audio, and video (hereinafter referred to as the "Content"), regardless of whether or not such Content may be used by persons other than the Purchaser. (Whether or not the Content can be used by any person other than the Purchaser is irrelevant.) The copyrights, patent rights, utility model rights, trademark rights, design rights, and all other intellectual property rights (including the right to apply for registration of these rights, etc.) related to the Content (regardless of whether or not they can be used by persons other than the Buyer, etc.) are the property of CoworkingKing, Inc. (including the right to apply for registration of these rights, etc.) are reserved to CoworkingKitchen, Inc. In other words, possession of the NFT or the data pertaining to the Contents (hereinafter referred to as the "NFT, etc.") does not mean that the intellectual property rights related to the Contents are transferred or licensed to you.

Therefore, even if you are the owner of the NFTs, you may not use the NFTs, etc. beyond the scope of personal viewing, commercial use, or other activities that legally require the approval of the rights holder (modification, publication, distribution, decompilation, and reverse engineering) without obtaining separate permission from CoworkingKitchen, Inc. (including but not limited to the change, publication, distribution, decompilation, and reverse engineering) (including, but not limited to, modification, publication, distribution, decompilation, and reverse engineering) is not permitted.

CoworkingKitchen, Inc. assumes no responsibility for any factual or legal defects (including, but not limited to, defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors or bugs) in the NFTs, etc., or for any damages that may result from the use of the NFTs, etc., in any environment. (iii) The Company does not warrant that the Service is free from factual or legal defects (including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors or bugs) or that the Service can be used in any environment. It shall not be liable for any damage caused by such defects or by the computer, line, software, platform, or other environment used by the Buyer, etc. In addition, the Company shall not be liable for any transactions, communications, or disputes between the Buyer and any third party in connection with the Service.

Notwithstanding the preceding, if CoworkingKitchen's liability is limited by the Consumer Contract Act or for any other reason, CoworkingKitchen's liability shall be limited to direct and ordinary damages incurred by the Buyer as a result of default or tortious behavior. In such cases, the maximum amount of compensation shall be the amount that CoworkingKitchen, Inc. first received from the purchaser as the sales price for this NFT. However, if the damage is caused by our company's willful misconduct or gross negligence, the compensation shall be made without these limitations.
